[Victory Report] From 250,000 to 1.04 Million: Well-Known Brand Wins Trademark Infringement Appeal, Joint Liability for Spouses

A well-known wood product company recently obtained a final judgment in a trademark infringement and unfair competition dispute case represented by Wang Chengen of the ACIES Team at Yingke Law Firm (Shenzhen) and Zhao Jianjie of Yingke Law Firm (Shanghai).

The Jiangxi High People’s Court reversed the first-instance decision, raising the damages from RMB 250,000 to over RMB 1.04 million. The court also held that the spouses who jointly operated the infringing store bore joint liability, and extended well-known trademark protection to non-identical categories.

In this case, the infringers had continuously used the client’s renowned trademark on an e-commerce platform since 2016, with the infringement lasting nearly eight years. The sales data obtained by the court alone exceeded RMB 55 million. In response to the infringers’ “brushed orders” defense, the appellate court explicitly stated that order brushing is an act of bad faith, and the perpetrators must bear the corresponding commercial risks.

The increase from RMB 250,000 to RMB 1.04 million is not merely a numeric jump—it represents a powerful deterrent against willful infringers and a just response to the brand owner’s long-term efforts to protect its rights.
