In a series of trademark infringement disputes represented by attorney Lawrence Wang of the ACIES team, the final—also the 12th—favorable judgment was recently obtained after nearly 3 years of litigation.
Keyword 1: 1 Case Split into 5
The plaintiff originally entrusted other lawyer to sue a company for trademark infringement. Although they won the first instance, the case was remanded for retrial at the appellate stage. The plaintiff then transferred this case to the ACIES team.
Due to the omission of parties in the original lawsuit, the ACIES team applied to the first-instance court to add co-defendants after the case was remanded, but the application was denied. Consequently, the team had to file separate lawsuits against the relevant co-defendants based on different infringing acts. What was originally a single case in Shenzhen turned into 5 separate cases, tried by courts in both Shenzhen and Zhongshan.
Keyword 2: 14 Defendants
Across the 5 cases, there were 24 defendant appearances involving 14 different legal entities or individuals.
Keyword 3: Another Remand for Retrial
4 of the 5 cases progressed relatively smoothly. Infringement was affirmed in all four, and in two of them, the amount of damages was even increased at the appellate stage. 1 case, while resulting in a favorable first-instance ruling for the client, was remanded again by the appellate court due to an omission of part of the plaintiff’s claims.
Keyword 4: Nearly 3 Years of Litigation
The ACIES team was entrusted with the case in May 2022, and the final judgment was obtained only recently—nearly 3 years later.
Keyword 5: 12 Victorious Judgments
Courts in Shenzhen and Zhongshan issued a total of 12 judgments across the 5 cases, all confirming that the defendants had committed trademark infringement.
The ACIES team secured a complete victory for the client.
