Attorney Lawrence Wang of the ACIES Team collaborated closely with Attorney Fan Chengji of AllBright Law Offices (Suzhou), and Attorneys Chen Lihang and Wang Huayong of Yingke Law Firm Shenzhen Office to represent Defendant A Company and its employees in an ownership dispute brought by Company B over two invention patent application rights under A Company’s name, arising from employee mobility.
The case spanned a lengthy timeline, involved complex technical issues, and included nine parties—including independent claimants such as publicly traded pharmaceutical company C and a renowned university—making it highly complex in both factual and procedural terms. After seven hearings, the first-instance court ruled that the two patent application rights were either jointly owned by A and B Companies or solely owned by B Company.
Both cases were appealed by multiple parties. At the second-instance stage, the Supreme People's Court convened three hearings, during which the defense legal team worked collectively to assist the court in fact-finding and thoroughly articulated the defendants’ legitimate claims.
The Supreme People's Court ultimately vacated the first-instance judgments in both cases and dismissed all claims of Plaintiff B, delivering a full victory for the defendants.
